Official Contest Rules for “89X’s I’m with the Band Version 2.0”

1. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. To enter the “89X’s I’m With the Band Version 2.0” contests (the “Contest”) by CIMX FM, entrants must submit a CD or MP3 of their music to 30100 Telegraph STE 460 Bingham Farms MI 48025, or 1640 Ouellette Avenue, Windsor, Ontario N8X1L1. All submissions must be postmarked by January 18, 2008. Each week for a TBD amount of weeks on 89Xradio.com and Myspace.com/89XImwiththeband, 4 different bands will have one song posted online that will be selected by 89X. Listeners can vote for their favorite and a running total of votes will be available to view. Voting each week will begin before 12 noon on Friday and continues until the following Thursday at noon. The band with the most votes each week at the time the voting ends will receive 1/3 of the points necessary to move on to the semi finals. Decisions made by CIMX are final in all matters, including voting period timeline, as well as which band received the most votes. Only 1 vote per day will be allowed to be submitted per IP address. Each Thursday night, the 4 bands whose songs were voted on on-line will play live at TNT’s Bar and Grill, 35101 Harper, Clinton Twp. MI 48035. The band who brings in the most number of people will receive 1/3 of the points necessary to move on to the semi finals, and the band that is deemed to have the best stage presence as decided by employees of TNT’s and CIMX will also receive 1/3 of the points necessary to move on to the semi finals. In the event of a tie, TNT’s and CIMX will decide the winner. Decisions made by CIMX are final in all matters. The winner each week will move on to the Finals on TBD date at TNT’s. Then, on a TBD date and time, 89X will hold the finals for the “I’m With the Band Version 2.0” contest. A panel of music experts will choose a winner from the finalists. The panel of music experts will be chosen by 89X. This band will win the Grand Prize. CIMX, is not responsible for technical, hardware, software, cable, or telephone malfunctions of any kind, lost or unavailable network or telephone connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by CIMX, Sponsor or the Sponsor Affiliates, the user, or by any of the equipment or programming associated with or utilized in any contest or by any human error which may occur in the processing of the entries or calls in or administration of any the Contest which may limit an entrant's or caller’s ability to participate. Further, CIMX, Sponsor or the Sponsor Affiliates are not responsible for any lost, late, illegible, misdirected, mutilated, incomplete or postage-due mail.

2. ELIGIBILITY: All CIMX The contests contest are is open to legal residents of Ontario, Michigan, Ohio, and Pennsylvania of or over the age of 13 as of December 15, 2007. Employees of CIMX, and their respective partners, parent companies, divisions, subsidiaries, affiliates, trustees, licensees, are not eligible to participate in the Contest and/or win any prize. Additionally, relatives of and those living in the same household of such employees are not eligible to win. For the purposes of all contests, relatives are defined as mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren. CIMX is has sole discretion of any potential winner’s eligibility.

3. WINNERS/GRAND PRIZES: $10,000 USD furnished directly by TNT’s Bar and Grill, 35101 Harper, Clinton Twp. MI 48035. Studio time at a TBD recording studio to record a 5 song EP. (Terms and Conditions the sole discretion of CIMX and studio) No transfer or prize substitution is allowed. CIMX reserve the right to substitute a prize for a prize of equal or greater value. If Grand Prize winner chooses not to accept the prize, CIMX will not substitute another prize. All applicable federal, state and local taxes, including, without limitation, excise tax (including sales tax). Grand Prize winners may be required to sign an affidavit of eligibility and liability/publicity release, as and where instructed by CIMX, or the prize may be forfeited. Winners may also be required to provide their United States social security number or Canadian social insurance number for tax purposes.. Winner may also be required to provide his or her valid state issued driver’s license. The Grand Prize winners must be in possession of valid proof of citizenship satisfactory to applicable customs and immigration officials. The approximate value of the Grand Prize is $10,000 USD. If winner documentation is returned as undeliverable, a prize may be forfeited. Decisions made by CIMX are final in all matters, including interpretation of these official rules and awarding of the a prize. CIMX reserves the right to amend the Competition or Program rules or terminate the Competition at any time without any liability to any Band or Band member. If legitimately claimed, the prize will be awarded.

4. ODDS OF WINNING: The odds of winning the a prize depend upon the number of entrants.

5. LIMITATION ON LIABILITY / DISCLAIMER / OTHER REQUIREMENTS: All entrants, as a condition of entry, agree to be bound by these official rules and the decisions of CIMX. Except where prohibited by law, by entering this Contest, each winner entrant consents to the use of his/her name, voice, picture, likeness and biographical data and/or any other information contained in his/her entry in advertising, promotional and marketing materials by CIMX in all media now known or hereafter discovered without additional compensation, notice, review or approval. All entrants further acknowledge that if they are chosen as a winner, certain of their personally identifying information will not disclosed to third parties but will be as required by law, including, without limitation, on a winners list. If any the contestants is not capable of running as planned, including, without limitation, because of human error, bugs, tampering, unauthorized intervention, fraud, technical failure or other cause beyond the control of CIMX which corrupts or threatens to corrupt or adversely affects the administration, security, fairness, integrity or proper conduct of the Contest, CIMX reserves the right, in its sole discretion, to cancel, suspend and/or modify this Contest and CIMX can conduct an alternate sweepstakes in order to award the prize, in its sole discretion.

PARTICIPANTS AGREE TO RELEASE CIMX FROM ANY AND ALL LIABILITY, CLAIMS OR ACTIONS OF ANY KIND WHATSOEVER FOR INJURIES, DEATH, DISABILITY, ATTORNEYS’ FEES, COSTS OF LITIGATION AND SETTLEMENT AS WELL AS DAMAGES OR LOSSES TO PERSONS AND PROPERTY THAT MAY BE SUSTAINED IN CONNECTION WITH THE RECEIPT, OWNERSHIP OR USE OF THE PRIZE, PARTICIPATING IN ANY CONTEST OR WHILE TRAVELING TO AND/OR FROM A LOCATION TO OBTAIN OR USE THE PRIZE OR PARTICIPATE IN A CONTEST. CIMX DOES NOT MAKE ANY WARRANTY, REPRESENTATION, OR GUARANTEE, EXPRESS OR IMPLIED, IN FACT OR IN LAW, RELATIVE TO THE USE OF THE PRIZE INCLUDING, WITHOUT LIMITATION, QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ANY AUTOMOBILE WARRANTIES IMPOSED BY LAW, WHETHER NOW KNOWN OR HEREAFTER ENACTED.

Bands must at all times behave appropriately when taking part in the Competition and/or Program, and observe the Competition and Program rules and any other rules or regulations in force at the studios and/or locations. CIMX reserves the right in its absolute discretion to remove from the Program, studio premises or location any Band who breaks such rules and/or fails to behave appropriately, and to disqualify such Band. All Bands agree that CIMX and its agents can use, exploit and distribute, in any media whatsoever, now known or hereafter created, worldwide in perpetuity, the Band's audition(s), performances and appearances, speeches, interviews and comments and the Band's name, trade-mark, likeness, image or voice without any further consent or compensation of any nature or kind. All Bands and all members thereof agree to waive any and all copyright interest, of any nature or kind, they may have in their comments, audition(s), performances and appearances including, without limitation, any moral rights in the foregoing.

Any person who supplies false information, enters by fraudulent means, or is otherwise determined to be in violation of these official rules in an attempt to obtain the prize will forfeit the prize won and may be prosecuted to the fullest extent of the law. Each entrant agrees not to knowingly: damage or cause interruption of the contestants; prevent others from using the Contest; or obtain or modify another’s information without their consent. Submission of an entry or an attempt to call in for a chance to win is acknowledgment of and agreement to be bound by all terms and conditions of these official rules.
